Biography:
Mr. Herrick has been an associate with the firm since 2001.  His practice is focused on litigation, particularly the defense of medical malpractice and legal malpractice actions.  He has represented both medical doctors and chiropractors throughout the state of Michigan.  He has represented attorneys in legal malpractice claims, in a number of different areas, including no-fault automobile claims, real estate transactions, buy-sell agreements for medical practices, as well as a shareholder derivative action.  Mr. Herrick has also assisted in the defense of a shareholder derivative action, through a director’s and officer’s insurance policy.  His experience includes all aspects of litigation including drafting, written discovery and taking depositions of fact and expert witnesses, medical record retention, review and summary.  He has argued discovery motions, dispositive motions and motions in limine in circuit courts in Oakland, Macomb, Wayne, Washtenaw, Genesee, Livingston, Lenewee, and Bay County.

He represents individuals in district courts relating to civil infractions and traffic citations, and has successfully pled costly moving violations down to nonmoving and non-abstracted infractions (i.e. no points), saving clients thousands of dollars in potential insurance costs.  Mr. Herrick has experience handling landlord and tenant issues on behalf of the landlord, including disputes regarding the tenant’s security deposit.

Mr. Herrick attended Albion College obtaining a B.A. in Economics and Management in 1997 and a law degree from the University of Detroit-Mercy School of Law in 2001 www.law.udmercy.edu While in law school, Mr. Herrick worked as a law clerk for this firm gaining invaluable knowledge regarding the operation of the state and federal courts, as well as learning practical aspects of law.

Mr. Herrick has participated in many medical malpractice and legal malpractice trials.  In 2009, he served as second chair in a wrongful death/medical malpractice action involving a kidney transplant in Oakland County Circuit Court.  The Jury returned a verdict in favor of the Defendants after six days of trial.  Trial responsibilities routinely include identifying, preparing and organizing exhibits, preparing expert witnesses for testimony, drafting motions in limine and jury instructions.

Mr. Herrick prides himself on providing personal attention to his clients, particularly the physicians and chiropractors he represents so that they have a complete understanding of the legal process and guidance through a malpractice claim from start to finish.
